These Terms of Service ("Terms") govern your access to and use of Hyper X Ultra (the "Service"), including our website, desktop application, and related features. By creating an account, signing in with X, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Hyper X Ultra is a tool that helps you grow your own X (formerly Twitter) account. It assists with composing replies in your voice and running paced, humanlike follow and unfollow activity. The desktop application performs these actions inside your own logged-in browser session, on your behalf and under your control. The Service does not call X's private automation endpoints and is designed to operate at a human-like pace.
You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for ensuring your use complies with all laws that apply to you.
The Service interacts with X on your behalf using your own authenticated session. You are solely responsible for your X account and for ensuring your use of the Service complies with X's Terms of Service, Developer Agreement, and any other rules X publishes. X is an independent third party. We are not affiliated with, endorsed by, or sponsored by X Corp.
Important: Automation of any kind carries risk on third-party platforms. X may, at its sole discretion, rate-limit, restrict, suspend, or ban accounts. While Hyper X Ultra is built to behave conservatively and humanlike, we cannot and do not guarantee that your account will not be actioned by X. You use the Service at your own risk.
You agree not to use the Service to:
You sign in through X's official authorization flow; we never receive or store your X password. You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it. Notify us promptly of any unauthorized use.
The Service offers a free tier and paid subscription plans. Paid plans are billed in advance on a recurring basis through our third-party payment processor. By subscribing, you authorize recurring charges until you cancel. You may cancel at any time; cancellation stops future renewals and takes effect at the end of the current billing period. Except where required by law, payments are non-refundable. Prices may change with notice; changes apply to subsequent billing periods.
Significant parts of the Service depend on our backend and on third-party platforms (including X). The Service may be unavailable, interrupted, or modified at any time. We may add, change, or remove features, and we may suspend or terminate access for any account that violates these Terms or that we reasonably believe creates risk or legal exposure.
The Service, including its software, design, and content (excluding your own content and your X data), is owned by Hyper X Ultra and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose while your account is in good standing. All rights not expressly granted are reserved.
You retain ownership of the content you create. You grant us a limited license to process your content and X data solely to operate and provide the Service to you (for example, to learn your reply voice or to generate your growth report). See our Privacy Policy for details.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT ANY PARTICULAR RESULT, INCLUDING ANY AMOUNT OF GROWTH, FOLLOWERS, OR ENGAGEMENT, AND WE DO NOT WARRANT THAT YOUR X ACCOUNT WILL NOT BE RESTRICTED OR SUSPENDED BY X.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HYPER X ULTRA AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR ACCOUNT STANDING. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE THREE MONTHS BEFORE THE CLAIM OR USD $50.
You agree to indemnify and hold harmless Hyper X Ultra and its operators from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms or of any third party's rights.
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms or to comply with the law. Provisions that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and indemnification) will survive.
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance.
